A Final EIR (FEIR) has been prepared and is available for public review.
The FEIR for the proposed Portola Terrace project includes written response to received public comments on the DEIR and also includes revisions (any additions and/or corrections) to the Draft EIR (DEIR). It is noted that revisions within the FEIR include clarifying language regarding intent, consistency and other non-substantive changes, but none of the corrections and additions constitute “significant new information” as defined by CEQA Guidelines Section 15088.5. “New information” is not significant unless the EIR is changing in a way that deprives the public of a meaningful opportunity to comment upon a substantial adverse environmental effect of the project or a feasible way to mitigate or avoid such an effect.
The FEIR will be considered by the Town Council at the future public meeting (not yet formally scheduled but targeted for November or December 2024). in conjunction with the requested project entitlements noted above. It is important to note that certification of an EIR does not approve or disapprove a project, but rather concludes that the EIR has been completed to comply with CEQA and state law, and determines whether the project would or would not have a significant effect on the environment.
The FEIR can be viewed here. A hard copy of the FEIR is also available for viewing at Town Hall and the Town Library.
The Town is providing an opportunity for members of the public to review the Final EIR prior to certification, though this is not a requirement of CEQA. Comments on the FEIR can be emailed to portolaterrace@portolavalley.net or mailed and/or dropped off to:
